Andy was highlighted in an article in Newsday on March 7, 2011. He has been appointed Chapter 7 Trustee of the Nassau County law firm of Korn & Spirn. Creditors put the firm into an involuntary bankruptcy.
Last May (2010), Jay Korn committed suicide by jumping off the roof of his office building. That was apparently prompted by pressure he was getting from “investors” who wanted monies returned to them on investments orchestrated by Korn that were apparently run through the firm’s escrow account. That money is missing as are moneys entrusted to the firm for contract deposits on real estate, etc. Andy is awaiting books and records seized by the Nassau County District Attorney’s Office and upon receipt, he will analyze and see what preferences and clawbacks might be available to creditors who were left holding the bag. This appears to be the latest major "Ponzi scheme" in the New York metro area, following the Bernie Madoff scandal and the Agape World/Nicholas Cosmo travesty. Creditors are fortunate to have Andy involved as Trustee, as he can endeavor to recover funds on their behalf. * * * * * 7 Members of ART

Aaron, who serves as Chairperson of the Adoption Committee of the New York State Bar Association, has been appointed by the President of the Nassau County Bar Association to serve as vice Chair of the Task Force on Adoption which is a prelude to the official designation of the Adoption Committee as a standing Committee of the Nassau Bar. Aaron will also be a speaker at the Dean’s hour luncheon to be held at noon on Monday, September 21, 2009, on the subject of Ethics in Adoption Law, and attendees will receive one CLE Ethics credit. * * * * * Stewart Wurtzel and Troy Rosasco Stewart and Troy teamed up on behalf of the Town of Oyster Bay Housing Authority to obtain a favorable landlord-tenant decision from the District Court Nassau County. The Court, in an apparent decision of first impression, found that the the Town of Oyster Bay did not waive its rights to evict a tenant who had created a nuisance by demanding, suing for and accepting rent for the period after an initial notice of termination was effective but before the administrative review upholding the termination was complete. The Court also found that no waiver could occur where the tenants complained of conduct that jeopardized the health, safety and welfare of other tenants in the community. Schwartz Alan was interviewed for an article published in the Long Island Business News dealing with video recording of police interrogations, entitled, "Interrogation Room With a View." The relevant excerpt follows: Advocates say videotaping interrogations captures abuse, protects interrogators from false charges and reveals state of mind. Alan Schwartz, a former prosecutor turned criminal defense attorney in Garden City, said video shows context. "If I’m watching the videotape and see an individual is in distress or high on drugs or alcohol, that becomes abundantly clear," Schwartz said. Thomas P. Sullivan, former U.S. attorney for the Northern District of Illinois, in hundreds of interviews with police, found "virtually every officer with whom we spoke, having given custodial recordings a try, was enthusiastically in favor of the practice." Illinois, Alaska, Illinois, Minnesota, Maine, New Mexico, North Carolina, Denver, Los Angeles, Phoenix and Portland require videotaping in serious cases, such as homicide. "They went above and beyond to give him the opportunity to assert any right or complaint he had," because the tape was rolling, Schwartz said. Schwartz said recording the entire process would force "law enforcement to be on their best behavior because they know they're being observed."* * * * * Saundra M. It is a practice filled with technicalities, short deadlines and hard to define standards. It is further complicated by the fact that most of the lower court cases or the appellate cases on the subject are not widely reported. Add to the mix that the loss of one's residence or business location can have tremendous economic and psychological consequences. Always in the background is the historic battle between landlord and tenant and the ever-changing social and legal policies which attempt to balance the rights of both landlord and tenant. Finally factor into the equation that the proceeding is called a "summary proceeding" because it is supposed to result in the prompt determination of the parties' rights, but, with appeals, a landlord tenant proceeding can linger for years. It is beyond the ken of this article to give full details as to all of the laws and procedures affecting this practice, but every lawyer should be knowledgeable about some basic landlord tenant principles so that the rights of the client can be adequately protected when time to reflect, research and advise may be at a minimum.....
